The Information Management Journal/September / October 2007- Today?s explosion of electronic data, coupled with the December 2006 amendments to the Federal Rules of Civil Procedure (FRCP) concerning electronically stored information (ESI), requires information and legal professionals to expand their knowledge about handling electronic discovery. The recent changes to the FRCP include:

* Definitions and safe harbor provisions for the routine alterations of electronic files during routine operations such as back ups [Amended Rule 37(f)]

* Information about how to deal with data that is not reasonably accessible [Amended Rule 26(b)(2)(B)]

* How to deal with inadvertently produced privileged material [Amended Rule 26(b)(5)]

* ESI preservation responsibilities and the pre-trial conference. [Amended Rule 26(f)]

* Electronic file production requests [Amended Rules 33(d), 34, 26(f)(3), 34(b)(iii)]

There are many opinions about how ESI should be planned for, managed, organized, stored, and retrieved. Some of the available options are extremely costly in terms of their required financial and time commitments. Constantly changing technologies only add to the confusion. One area of confusion is the distinction between computer forensics and electronic discovery; there is a significant difference. Making the Right Choices

Successfully responding to e-discovery within the constraints of the amended FRCP requires organizations to make many critical decisions that will affect the collection and processing of ESI.

Processing Choices

Because of the volume of information available in even the smallest of collections, it becomes necessary to manage the process to control time and budget. The following questions need to be answered:

1. Who are the key people?

The people important to a case should be identified. These key individuals include not only executives, but also assistants and other support personnel from the technology, accounting, sales and marketing, operations, and human resources departments.

2. Where are the files located?

All the potential locations of electronic evidence should be identified. These include home computers and all computers that a key person would use elsewhere (such as a girlfriend or boyfriend?s home), cell phones, PDAs, Blackberries, and any other digital device that might be used. It is important to note that MP3 players, such as iPods, can also be used to store documents or important files.

By the year 2014 – just eight years away – there will be 3.6 million new jobs available in the medical profession, and the bulk of those jobs – about 60% of them – will be open to those with nursing degrees of one kind or another. The demand for registered nurses is highest – the Bureau of Labor Statistics estimates that the number of jobs available for registered nurses will rise by 27% by 2014 – but there will also be increased opportunities for certified nursing assistants, licensed practical nurses, nurse practitioners, physician’s assistants and those in medical technical fields like phlebotomy and pulmonology.

And if you thought that the only jobs available for nurses were in hospitals and medical facilities, the Bureau of Labor Statistics has more news for you. Less than 60% of registered nurses work in a hospital. A nursing degree opens doors of opportunity into so many fields that it’s easily one of the most versatile and useful degrees that you can acquire. Not only that – a nursing degree appeals to a wide range of people. According to the BLS, about 20% of those entering the nursing workforce are older workers starting on a second career. Many of them have been attracted by rising salaries triggered by the nursing shortage, but for many of them, a nursing degree is a chance to do something that makes them feel good.

Whether you’ve just started your nursing career, are returning to work after a hiatus, or are switching to a career in nursing as a second career, take a look at some of the opportunities that are open to you with a nursing degree.

Pediatric Home Health Care is one of the growing fields for those with nursing degrees. Every state in the Union now has some sort of Early Intervention program that identifies children under the age of three years with special needs. Pediatric home health care gives you the opportunity to work with children and parents and make a real difference in their lives.

Elder Home Health Care is the other end of the spectrum. The ‘aging of America’ means that more and more people require a little bit of help to remain in their homes. Nursing assistants, registered nurses and licensed nurses can provide that little bit extra that will allow a senior citizen to maintain a higher quality of life and remain at home when all they need is a few hours of medical care a day or week.

Working in a Blood Donor Center is an option that makes you part of the life-saving network. There’s more to blood donor centers than just starting IVs. Nurses who specialize in pharesis can command high salaries, and a nurse working in the blood collection field can be a valuable community organizer as well as a medical practitioner.

Craigslist is one of the most visited sites on the internet today, with millions upon, millions of visitors a day. With this many visitors
daily, it is very easy to get a nice chunk of traffic with your postings. I have put some tips together for you guys, apply these, and you WILL
make money!

Tip 1: DON’T POST DUPLICATE POSTS!
Posting duplicate posts will do nothing for you but get your ads taken down. Yes, it is easy to just copy and paste, and make over 100 ads within minutes, but it won’t do you any good.

Tip 2: USE DIFFERENT IPS!
Using different IPs is another way to avoid getting your ad flagged. One way Craigslist will know to flag your posts is by looking at the IP you are using. If they see multiple ads from the same IP, they will most likely flag your ad, thus your profits will suffer. (Wait, you won’t have any.) One way you can
change your IP is by using a proxy. If you want a list of them, check out proxy.org. They have thousands of them.

Tip 3: DONT BE AN IDIOT!
Being an idiot is the easiest way to not make money on Craigslist. Do not post something, blatantly spamming your URL. This is an example of what NOT to do:

“HEY GUYS CHECK OUT MY SITE ITS THE BEST!!!! LOL11!!! http://myaffiliatelink.com LOL OK GO THER PLX”

Doing this is also a good way to get banned from your CPA network as well, which also is not a good thing.

Sure, there’s more stress than what you probably imagined when you were creating your grand plans, but with a little strategy and planning you can overcome any tough spot you get in. There are 7 tactics developed by successful marketers that are sure to make your business as successful as theirs.

1. Create A One of a Kind Selling Point
If you want to stand out from the crowd, create a unique selling proposition that stresses the benefits the customers will receive from doing business with you. Will they get faster service? Go ahead and dramatize it, but keep the customer at the focus…”Get free overnight delivery!” Hey, it tells the customer…you get quick service and a discount on shipping. Two definite benefits in one statement.

Why should someone buy from you and not your competitor? I hate to deal a blow to your ego, but it really has nothing to do with you , your product, or your service. Yeah, its a little self-centered, but customers are attracted by offers that point out the things that benefit THEM.

Don’t go out on a limb to create new products and services to get attention. Just, add a special benefit to the ones you already have… maybe it’s quicker service. The most effective things to emphasize are benefits that your competition cannot or is not willing to give.

2. Use Testimonials
Hey, we all know that business owners think their product or services are the best thing going, but it’s what the current customers think about it that really matters to your prospective customers. They’re the ones who see things from their point of view… what they have to say about the business has an impact.

Testimonials play an important part in advertising – especially for small businesses. Yeah, big businesses with well-known names don’t have to worry about it, but small companies can use testimonials as marketing tools to build credibility.

Think about it…how else can we gain credibility than by creating a group of satisfied customers and shouting what they have to say? Let’s look at some ways we can make testimonials an effective part of our marketing campaigns.

3. Upsell
Upselling is one of the most successful marketing trends today. Everywhere you go, someone is trying to get you to buy more. From McDonalds with its supersize options to clothing stores that try to sell you shoes to match your outfit, everyone’s jumping on the band wagon. Why? It works!

Your customers already know that you have great products and provide satisfactory service. They trust you to come through for them. Think about it… it’s much easier to make sales to someone you already have a relationship with.

Use every opportunity to increase your sales volume within the customer audience you already have. Do you have a product that goes with the one they are purchasing? Offer it to them at the register. It’s a proven and effective method for increasing sales. You may be shocked at the additional sales you can generate from those who are already buying from you.

4. Make Your Price Seem Smaller
Divide and conquer… The old war tactic works in marketing too! When the price seems too steep, break it down into “buyable” size bites. An $120 item is only 12 low monthly payments of $10. A $365 purchase would only cost $1 per day. Now that sounds affordable!

5. Paint The Benefits Pretty
Customers buy because they want to enjoy the benefits of the purchase. A lady might buy a dress because she wants to feel sexy, or a man will buy a book because he finds pleasure in reading. Emotions are the key element that drives purchases.
